§ 3 TECHNICAL REQUIREMENTS

For the proper functioning and creation of the Account and the use of purchased Courses, the following are necessary:

  • an active e-mail account,
  • a device with internet access (computer, tablet or smartphone),
  • a web browser supporting JavaScript and cookies,
  • speakers or headphones enabling audio playback.

§ 4 ACCOUNT

  1. It is possible to use the Website and browse its content without creating an Account.

  2. Having an Account is required to purchase a Course in the Shop and to use purchased Courses.

  3. The Account enables the Service Recipient, in particular, to:

    • purchase Courses in the Shop,
    • access purchased Courses,
    • view order history,
    • download invoices,
    • edit their data independently.
  4. To create an Account, the registration form available on the Website must be completed, providing the required data, including an e-mail address and password.

  5. When the Account is created, a contract for the maintenance of the Account is concluded between the Service Recipient and the Service Provider for an indefinite period, on the terms set out in the Terms.

  6. The Service Provider begins providing the Account maintenance service immediately after the Account is created.

  7. The Service Recipient is obliged to keep the Account access data (login and password) confidential and not to disclose it to third parties.

  8. The Service Recipient may give up the Account at any time and without incurring any costs. To delete the Account, an appropriate request must be sent to the Service Provider's e-mail address indicated in § 2 of the Terms. The consequence of deleting the Account is termination of the contract for its maintenance and loss of access to purchased Courses. Deletion of the Account is not equivalent to a refund of payments for purchased Courses.

  9. The Service Provider is entitled to block or delete the Service Recipient's Account in the event of a breach by the Service Recipient of these Terms or the Shop Terms, in particular in the event of sharing the Account or purchased Courses with third parties.

§ 5 COMPLAINTS

I. General provisions

  1. The Service Provider asks that complaints concerning the Account be submitted to the postal or e-mail address indicated in § 2 of the Terms.

  2. The Service Provider will respond to a complaint within 14 days of receiving the report.

II. Privileged Service Recipients

  1. The Service Provider is liable to the Privileged Service Recipient for the conformity of the performance with the contract, on the terms set out in the Consumer Rights Act.

  2. In the event of improper performance of the contract for the maintenance of the Account, the Privileged Service Recipient may exercise the rights regulated in Chapter 5b of the Consumer Rights Act.

  3. If the Service Provider has not supplied the service, the Privileged Service Recipient may call on it to supply the service. If, despite the call, the Service Provider does not supply the service without undue delay or within the agreed period, the Privileged Service Recipient may withdraw from the contract for the maintenance of the Account.

  4. The Privileged Service Recipient may withdraw from the contract without calling for the service to be supplied if it is clear from the Service Provider's statement or from the circumstances that it will not supply the service, or if the agreed time for supply was of essential importance to the Privileged Service Recipient and the Service Provider failed to meet that time.

  5. If the Account does not conform to the contract, the Privileged Service Recipient may demand that it be brought into conformity with the contract.

  6. In the event of a lack of conformity of the Account with the contract, the Privileged Service Recipient is obliged to cooperate with the Service Provider, to the extent reasonably possible and using the least intrusive technical means, in order to determine the cause of the lack of conformity.

  7. The Privileged Service Recipient may make a statement of withdrawal from the contract for the maintenance of the Account where:

    • bringing the Account into conformity with the contract is impossible or requires excessive costs,
    • the Service Provider has not brought the Account into conformity with the contract within a reasonable time and without excessive inconvenience to the Privileged Service Recipient,
    • the lack of conformity of the Account with the contract persists despite the Service Provider's attempts to remedy it,
    • the lack of conformity of the Account with the contract is so significant that it justifies withdrawal from the contract without first requesting that it be brought into conformity,
    • it is clear from the Service Provider's statement or from the circumstances that it will not bring the Account into conformity with the contract within a reasonable time or without excessive inconvenience.

III. Out-of-court complaint and redress mechanisms

  1. The Service Provider informs the Consumer of the possibility of using out-of-court complaint handling and claim enforcement methods.

  2. The Consumer may, among other things, seek the assistance of the relevant European Consumer Centre. A list of centres is available at: https://konsument.gov.pl/eck-w-europie/

  3. The following forms of support are available in the Republic of Poland:

    • mediation conducted by the competent Voivodeship Inspectorate of the Trade Inspection: https://uokik.gov.pl/kontakt-inspekcja-handlowa
    • a permanent consumer arbitration court operating at the Voivodeship Inspectorate of the Trade Inspection: https://uokik.gov.pl/kontakt-inspekcja-handlowa
    • free assistance from a municipal or county consumer ombudsman.
  4. Using out-of-court complaint handling methods is voluntary for both the Service Provider and the Consumer.

§ 6 RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. The Privileged Service Recipient has the right to withdraw from the contract for the maintenance of the Account within 14 days of its conclusion, without giving any reason.

  2. To exercise the right of withdrawal, the Privileged Service Recipient must inform the Service Provider, using the details provided in § 2 of the Terms, of their decision by means of an unequivocal statement (e.g. an e-mail message).

  3. The Privileged Service Recipient may use the model withdrawal form placed at the end of the Terms, but this is not obligatory.

  4. To meet the withdrawal deadline, it is sufficient to send the statement before the deadline expires.

  5. Withdrawal from the contract for the maintenance of the Account is equivalent to its deletion and loss of access to purchased Courses. Withdrawal from the contract for the maintenance of the Account is not equivalent to withdrawal from the contract for the purchase of a Course and does not constitute grounds for a refund of payment for a Course. The rules for refunds of payments for a Course are governed by the Shop Terms.

§ 7 PERSONAL DATA

  1. The controller of the personal data provided by the Service Recipient in connection with the conclusion of the contract for the maintenance of the Account is the Service Provider. Detailed information on the processing of personal data can be found in the Privacy Policy available on the Website.

  2. The purpose of processing the Service Recipient's data is the maintenance of the Account. The basis for processing personal data is:

    • the contract for the maintenance of the Account or steps taken at the Service Recipient's request with a view to entering into it (Article 6(1)(b) GDPR),
    • the Service Provider's legitimate interest, consisting in processing data for the purpose of establishing, pursuing or defending potential claims (Article 6(1)(f) GDPR).
  3. Provision of data is voluntary, but necessary to conclude the contract for the maintenance of the Account. Failure to provide data will make it impossible to create the Account and, consequently — to purchase a Course.

  4. The Service Recipient's data will be processed until:

    • the contract for the maintenance of the Account ceases to apply,
    • the possibility of pursuing claims by the Service Recipient or the Service Provider lapses,
    • the Service Recipient's objection to the processing of their data is accepted — where the basis for processing was the Service Provider's legitimate interest.
  5. The Service Recipient has the right to request: access to their personal data, its rectification, erasure, restriction of processing, transfer of data to another controller, as well as the right to object to the processing of data.

  6. To exercise their rights, the Service Recipient should contact the Service Provider using the details in § 2 of the Terms.

  7. If the Service Recipient considers that their data is being processed unlawfully, they may lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).

§ 8 CHANGES TO THE TERMS OR THE ACCOUNT

  1. The Service Provider reserves the right to amend the Terms only for important reasons, such as:

    • a change in the functionality of the Account requiring modification of the Terms,
    • a change in legal provisions affecting the performance of the contract for the maintenance of the Account,
    • adaptation to recommendations, guidelines or decisions of authorised public authorities,
    • a change in the Service Provider's contact or identification details.
  2. Information on a planned amendment to the Terms will be sent to the Service Recipient's e-mail address assigned to the Account at least 7 days before the changes enter into force.

  3. If the Service Recipient does not object to the planned changes before the date they enter into force, they are deemed to have accepted them. This does not limit the right to terminate the contract in the future.

  4. If the Service Recipient does not accept the planned changes, they should inform the Service Provider of this at the e-mail address indicated in § 2 of the Terms, which results in termination of the contract for the maintenance of the Account upon the entry into force of the changes.

  5. The Service Provider may change the functionality of the Account in a way that is not necessary to maintain its conformity with the contract, for the reasons indicated in paragraph 1. Introducing such a change does not involve any costs for the Privileged Service Recipient.

  6. If the change referred to in paragraph 5 significantly and negatively affects the Privileged Service Recipient's access to or use of the Account, the Service Provider will inform them of the change, its characteristics and the date of its introduction, and of the rights they have, with reasonable advance notice.

§ 9 FINAL PROVISIONS

  1. The Service Recipient is prohibited from supplying unlawful content.

  2. The Service Recipient is not entitled to share the Account or access to purchased Courses with third parties.

  3. The contract for the maintenance of the Account is concluded in the Polish language.

  4. The contract concluded under these Terms is governed by Polish law, subject to paragraph 5.

  5. The choice of Polish law does not remove or limit the Consumer's rights under mandatory provisions of law applicable in their place of residence.

  6. In the event of a dispute with a Service Recipient who is not a Privileged Service Recipient, the competent court will be the court competent for the Service Provider's registered office.
