- a device with internet access (computer, tablet or smartphone),
- an up-to-date web browser supporting JavaScript and cookies,
- an active e-mail account,
- speakers or headphones enabling audio playback.
-
The Seller is not liable for technical problems resulting from the Buyer's failure to meet the above requirements.
§ 4 PURCHASES IN THE SHOP
-
The prices of Courses shown in the Shop are total gross prices (they include VAT).
-
The selected Course must be added to the basket in the Shop.
-
The Buyer then selects a payment method from the options available in the Shop and provides the data necessary to fulfil the order.
-
The order is placed at the moment the Buyer confirms its content and accepts the Terms.
-
Placing an order is equivalent to concluding a contract between the Buyer and the Seller.
-
The Buyer may register in the Shop, i.e. create an Account, or make purchases without registration by providing their data with each order.
-
After the contract is concluded, the Buyer receives confirmation of its conclusion at the e-mail address provided.
§ 5 PAYMENTS
-
The following payment methods are available in the Shop – through a payment platform:
- BLIK,
- bank transfer,
- payment card,
- PayU,
- [OTHER PAYMENT METHODS].
-
If the Buyer chooses prepayment, the order must be paid for within 7 Business Days of placing the order. Failure to pay within this period results in the order being cancelled.
-
By making purchases in the Shop, the Buyer accepts the Seller's use of electronic invoices. The Buyer has the right to withdraw their acceptance.
§ 6 ORDER FULFILMENT
-
The only items sold in the Shop are Courses constituting digital content delivered by electronic means.
-
Access to the purchased Course is granted through the Platform. Access data (login and password or an activation link) is sent to the e-mail address provided by the Buyer when placing the order.
-
The Seller begins fulfilling the order promptly after the payment has been credited, and no later than within 5 Business Days.
-
Access to the Course is granted for an indefinite period, unless the description of the Course in the Shop provides otherwise.
-
The Seller reserves the right to update the content of the Course in order to keep it current and of good quality, of which the Buyer will be informed.
§ 7 RIGHT OF WITHDRAWAL FROM THE CONTRACT
-
As a general rule, a Privileged Buyer has the right to withdraw from a contract concluded with the Seller through the Shop within 14 days without giving any reason, subject to § 8 of the Terms.
-
The period for withdrawing from the contract expires 14 days after the day on which the contract for the supply of digital content was concluded.
-
To exercise the right of withdrawal, the Privileged Buyer must inform the Seller, using the details provided in § 2 of the Terms, of their decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by e-mail).
-
The Privileged Buyer may use the model withdrawal form placed at the end of the Terms, but this is not obligatory.
-
To meet the withdrawal deadline, it is sufficient for the Privileged Buyer to send information concerning the exercise of their right of withdrawal before the withdrawal period expires.
Effects of withdrawal from the contract
-
In the event of withdrawal from the concluded contract, the Seller shall reimburse the Privileged Buyer for all payments received from them promptly, and in any case no later than 14 days from the day on which the Seller was informed of the Privileged Buyer's decision to exercise the right of withdrawal.
-
The Seller will refund the payment using the same payment method as the Privileged Buyer used in the original transaction, unless the Privileged Buyer agrees to a different solution. In any case, the Privileged Buyer will not incur any fees in connection with this refund.
-
Upon refund of the payment, the Seller deactivates the Privileged Buyer's access to the Course.
§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL FROM THE CONTRACT
-
The right of withdrawal referred to in § 7 of the Terms does not apply to a Privileged Buyer in respect of a contract for the supply of digital content not supplied on a tangible medium, if performance has begun with the Privileged Buyer's express consent before the expiry of the withdrawal period and after the Seller has informed them of the loss of the right of withdrawal.
-
In practice, this means that if the Privileged Buyer has consented to immediate access to the Course at the time of purchase and has been informed of the loss of the right of withdrawal — the statutory right of withdrawal expires upon access to the Course being granted.
-
The above does not limit the rights arising from the voluntary Money-back Guarantee described in § 9 of the Terms.
§ 9 VOLUNTARY MONEY-BACK GUARANTEE
-
Irrespective of the statutory right of withdrawal from the contract and its possible limitations described in § 7 and § 8 of the Terms, the Seller grants each Buyer a voluntary money-back guarantee, on the following terms:
-
The Buyer may submit a request for a refund of the full price paid for the Course within 30 days from the day access to the Course is granted, without giving any reason.
-
The refund request must be sent to the Seller's e-mail address indicated in § 2 of the Terms or via the refund form available in the Shop, stating:
- first name and surname,
- the e-mail address used for the purchase,
- the order number.
-
The Seller will consider the refund request within 14 Business Days of receiving it and will refund the payment using the same payment method as was used for the purchase, unless the Buyer expressly agrees to a different method of refund.
-
Upon refund of the payment, the Buyer's access to the Course is deactivated.
-
This guarantee is a voluntary undertaking of the Seller and does not limit or exclude the statutory rights of the Privileged Buyer arising from the provisions of law.
§ 10 COMPLAINTS
I. General provisions
-
The Seller is liable to the Privileged Buyer for the conformity of the Course (digital content) with the contract, on the terms set out in the Consumer Rights Act.
-
Complaints may be submitted to the e-mail address or postal address indicated in § 2 of the Terms.
-
The Seller will respond to a complaint within 14 days of receiving it.
II. Privileged Buyers
-
If the Course does not conform to the contract, the Privileged Buyer may demand that it be brought into conformity with the contract.
-
The Seller may refuse to bring the Course into conformity with the contract if this is impossible or would require excessive costs for the Seller.
-
If the Course does not conform to the contract, the Privileged Buyer may make a statement reducing the price or withdrawing from the contract where:
- bringing it into conformity with the contract is impossible or requires excessive costs,
- the Seller has not brought the Course into conformity with the contract within a reasonable time,
- the lack of conformity with the contract is so significant that it justifies an immediate price reduction or withdrawal from the contract.
-
The Privileged Buyer may not withdraw from the contract if the lack of conformity of the Course with the contract is insignificant.
-
The Seller is liable for any lack of conformity of the Course with the contract that exists at the time of its supply and becomes apparent within two years of that time.
III. Out-of-court complaint and redress mechanisms
-
The Seller informs the Consumer of the possibility of using out-of-court complaint handling and claim enforcement methods. The rules for accessing these procedures are available on the websites of the entities authorised to resolve disputes out of court.
-
The Consumer may, among other things, seek the assistance of the relevant European Consumer Centre. A list of centres is available at: https://konsument.gov.pl/eck-w-europie/
-
The following forms of support are available in the Republic of Poland:
- mediation conducted by the competent Voivodeship Inspectorate of the Trade Inspection: https://uokik.gov.pl/kontakt-inspekcja-handlowa
- a permanent consumer arbitration court operating at the Voivodeship Inspectorate of the Trade Inspection: https://uokik.gov.pl/kontakt-inspekcja-handlowa
- free assistance from a municipal or county consumer ombudsman.
-
Using out-of-court complaint handling methods is voluntary for both the Seller and the Consumer.
IV. Buyers other than Privileged Buyers
-
If the Course does not conform to the contract, a Buyer other than a Privileged Buyer may make a claim in respect of the Course under the provisions of the Civil Code on statutory warranty (rękojmia).
-
In relation to a Buyer other than a Privileged Buyer, the Seller is liable under the statutory warranty if the defect is found before two years have elapsed from the date of conclusion of the contract.
§ 11 PERSONAL DATA
-
The controller of the personal data provided by the Buyer when using the Shop is the Seller. Detailed information on the processing of personal data can be found in the Privacy Policy available in the Shop.
-
The purpose of the Seller's processing of the Buyer's data is the fulfilment of orders. The basis for processing personal data is:
- a contract or steps taken at the Buyer's request with a view to entering into it (Article 6(1)(b) GDPR),
- a legal obligation incumbent on the Seller, relating in particular to accounting (Article 6(1)(c) GDPR),
- the Seller's legitimate interest, consisting in processing data for the purpose of establishing, pursuing or defending potential claims (Article 6(1)(f) GDPR).
-
Provision of data by the Buyer is voluntary, but at the same time necessary to conclude the contract. Failure to provide data will make it impossible to conclude the contract.
-
The Buyer's data will be processed until:
- the contract between the Buyer and the Seller ceases to apply,
- the legal obligation requiring the Seller to process the Buyer's data ceases to apply to the Seller,
- the possibility of pursuing claims by the Buyer or the Seller lapses,
- the Buyer's objection to the processing of their personal data is accepted – where the basis for processing was the Seller's legitimate interest.
-
The Buyer has the right to request: access to their personal data, its rectification, erasure, restriction of processing, transfer of data to another controller, as well as the right to object to the processing of data.
-
To exercise their rights, the Buyer should contact the Seller using the details in § 2 of the Terms.
-
If the Buyer considers that their data is being processed unlawfully, they may lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
§ 12 RESERVATIONS
-
The Buyer is prohibited from supplying unlawful content.
-
Each order placed in the Shop constitutes a separate contract and requires separate acceptance of the Terms. The contract is concluded for the duration and for the purpose of fulfilling the order.
-
The Buyer is not entitled to share purchased Courses with third parties, or to copy or distribute the content of the Course in any form, without the Seller's prior written consent.
-
All contracts concluded under these Terms are governed by Polish law, subject to paragraph 5.
-
The choice of Polish law does not remove or limit the Consumer's rights under mandatory provisions of law applicable in their place of residence.
-
Contracts concluded under the Terms are concluded in the Polish language.
-
In the event of a dispute with a Buyer who is not a Privileged Buyer, the competent court will be the court competent for the Seller's registered office.
-
The Seller reserves the right to amend the Terms for important reasons. Buyers who hold an Account will be informed of any amendment to the Terms at least 14 days in advance. Amendments to the Terms do not affect the Buyers' acquired rights.
